Woman alleges Orkin failed to remove bats and she had to purchase new home

GRAFTON – A Grafton woman alleges she had to move out of her house because a pest control company failed to remove the bats it was contracted to do.

Clara E. Wolfe filed a complaint in Taylor Circuit Court against Orkin LLC, Brian Butcher, Scott Flynn and Alexander Golash and John Does alleging breach of contract, fraud and other counts.

The suit states that the plaintiff contacted Orkin about removing bats and bat guano from her attic in summer 2018. On July 17, 2018, the suit states Orkin employees Butcher and Flynn informed the plaintiff that they could remove the bats and the guano and also convinced her she needed new insulation in her attic.

The suit states Golash came to the plaintiff's home to remove the bats and installed the insulation. The plaintiff alleges that Golash and the other employees who performed the work were not adequately licensed to remove the bats. She alleges another company she hired to inspect the house determined that the defendants did not remove the old insulation prior to installing the new and did not remove all of the bats and bat guano.

The plaintiff alleges despite of the protective barriers installed by Orkin to prevent bats from entering her attic, bats were found in the attic again in December 2018. Because of medical issues related to the bats, she had to purchase a new home.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Hunter B. Mullens of Mullens & Mullens PLLC in Philippi.
