Couple alleges Customized Services Administrators improperly denied travel insurance claim over cruise

CHARLESTON – A Kanawha County couple alleges a travel agency improperly denied their travel insurance claim.

Manoochehr Saidi and Patricia Saidi filed a complaint in Kanawha Circuit Court against Customized Services Administrators Inc. alleging first party bad faith and fraudulent inducement.

The suit states that the plaintiffs purchased a cruise package from Grand Bahama Cruises on Aug. 13, 2015, and purchased travel insurance through the defendant. The suit states they then purchased an 18-month extension of their cruise in February 2017. 

The plaintiffs allege they attempted to book their vacation on March 16, 2018, but could not access the Grand Bahama Cruises through their website. The plaintiffs contacted the company on March 23, 2018, but were told that the package had expired despite purchasing the extension. 

The plaintiffs allege they tried to use their travel insurance that they had purchased through the defendant but it did not work. They allege the defendant informed them in April that the coverage they purchased required they be on their trip during the coverage period in order for it to apply.

The plaintiffs allege the defendant improperly denied their insurance claim by relying on an improper exclusion not in the advertising material they relied on when purchasing the insurance.

The plaintiffs are seeking all reasonable sums due, attorney fees and court costs. The plaintiffs are represented by Scott H. Kaminski of Kaminski Law PLLC in Charleston.

The case has been assigned to Judge Charles King.
