Man alleges negligent care of Jan-Care Ambulance Service contributed to brother's death

BECKLEY – A Hinton man is suing a medical transportation company alleging that his brother's death was caused in part due to its allegedly negligent care.

Robert M. Bragg, administrator of the estate of Elsworth J. Bragg, filed a complaint in Raleigh Circuit Court against Jan-Care Ambulance of Raleigh County Inc., doing business as Jan-Care Ambulance Service, alleging negligence and wrongful death.

The suit states that Elsworth J. Bragg was in the defendant's care from April 1, 2017, to Feb. 15, 2018, and the defendant transported him to and from his residence at Hilltop Center. The suit states while under the defendant's care, Elsworth J. Bragg fell several times and fractured his right femoral neck. The suit states he died June 3, 2018.

The plaintiff alleges the defendant failed to provide his brother with an assessment of his risk of falls.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Jeff D. Stewart, Andrew L. Paternostro and S. Andrew Stonestreet of Stewart Bell PLLC in Charleston.

The case has been assigned to Circuit Judge Andrew Dimlich.
