Widower files suit against Teays Valley Assisted Living over wife's fall-related death

WINFIELD – A Scott Depot man is suing a Hurricane assisted living facility alleging that his wife died due to negligence of its care team.

James Estes, as executor of the estate of Jeanetta Imogene Estes, filed a complaint in Putnam Circuit Court against Teays Valley Assisted Living Inc. alleging breach in the standard of care.

The suit states that Jeanetta Estes was a resident of the defendant's facility from Feb. 20 to Feb. 24. During the course of her stay she was a fall risk, but the defendant allegedly failed to take the necessary precautions to protect the decedent. The suit states Jeanetta Estates fell a number of times and one of the falls proved fatal due to intercranial bleeding, which led to her death on Feb. 28.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Damon Ellis of Mani, Ellis & Layne PLLC in Charleston.

The case has been assigned to Judge Phillip Stowers.
