Nurse alleges Raleigh General Hospital terminated him without final warning

BECKLEY – A man is suing his former Raleigh County hospital employer alleging that he was unfairly terminated without warning.

Matthew Shamblin filed a complaint in Raleigh Circuit Court against Raleigh General Hospital LLC alleging breach of contractual duty.

The suit states that the plaintiff was employed by the defendant as a licensed practical nurse beginning in February 2012. The plaintiff alleges he was not given a final warning as was required by the defendant's policy before he was terminated on June 3, 2018. He alleges the defendant applied the policy differently among employees and did not promote a fair working environment.

The plaintiff is seeking all compensatory, punitive and consequential damages; attorney fees; and court costs. The plaintiff is represented by Kyle G. Lusk of Lusk & Bradford PLLC in Beckley.

The case has been assigned to Circuit Judge H.L. Kirkpatrick.
