CHARLESTON — Several individuals are suing MVB Bank for looting of several companies and failing to pay back promissory notes.

MVB Bank Inc.; Larry F. Mazza and Brian D. Gallagher; and Robert Maxwell Chilton and Alice Chilton Zuber were all named as defendants in the suit.

Michael DeVan, Robert R. Chilton, Cynthia Barrett, Nellie Jamieson, William Lewis Chilton, Cynthia Chilton Wilson and William Ruffner Chilton filed the lawsuit against the defendants in Kanawha Circuit Court alleging the defendants failed to pay on a promissory note equal to 40 percent of the plaintiffs' interest in and to the stock of Twelve Sixty-six Corporation.

The plaintiffs are seeking award of declaratory and injunctive relief against the defendants; an order compelling Robert Chilton and Zuber to account for their financial dealings; a monetary judgment; and litigation costs. They are represented by William V. DePaulo.
