Skateboarder sues West Virginia Paving for injuries

CHARLESTON —  A man is suing West Virginia Paving Inc. for skateboarding injuries he claims were due to its negligence.

Ray Hartzell was skateboarding on Aug. 24, 2017, just before nightfall at Hinton Terrace when he fell and injured his wrist and scraped his elbows and knees, according to a complaint filed in Kanawha Circuit Court.

Hartzell claims he noticed that the area was under construction, but there were no markers left by the defendant's employees and a three-inch hole and rough payment were left without any markers in the area.

The defendant should have placed warning markers around the construction area and failed to do so, according to the suit.

Hartzell is seeking compensatory damages with pre- and post-judgment interest. He is represented by Joseph H. Spano Jr. of Pritt & Spano.
