Woman injured in car crash sues driver who hit her, State Farm Insurance

HUNTINGTON – A woman who was injured when a truck rammed her vehicle from behind filed a lawsuit against the man driving the truck and State Farm Insurance.

Ruia Roberts filed the complaint in Cabell Circuit Court against Richard Rectenwald and State Farm Mutual Automobile Insurance Company.

On Feb. 14, 2018, Roberts was waiting for a vehicle in front of her to turn when Rectenwald rear-ended her, the lawsuit said. She suffered serious injuries in the crash. She wrote a letter to her insurer, State Farm, requesting her coverage be paid out, but State Farm denied the claim, saying she had to settle with Rectenwald first, the lawsuit said.

Rectenwald's coverage was not sufficient to cover her damages and injuries, the lawsuit said, but State Farm has still not paid on her policy, the lawsuit said.

Roberts accused Rectenwald of negligence and reckless driving, and she accused State Farm of breach of contract and common law bad faith in the lawsuit.

She is represented by R. Edison Hill of Hill, Peterson, Carper, Bee & Detzler PLLC in Charleston.

The case has been assigned to Judge Paul Farrell.
