Family Dollar customer blames food tray on fall in store

HUNTINGTON – A Family Dollar customer alleges she fell in the store because the legs of a food tray were in the aisle and caused her to trip.

Joyce Huffstutler filed a complaint in Cabell Circuit Court against Family Dollar Stores of West Virginia LLC alleging negligence.

The suit states that the plaintiff was on the defendant's premises on Sept. 2, 2018, in Milton and was caused to trip and fall to the ground by the legs of a food tray that was protruding out into the aisle. She alleges she injured her face, back and neck as a result of the fall.

The plaintiff alleges it was the defendant's responsibility to maintain the store in a safe manner.

The plaintiff is seeking a trial by jury. The plaintiff is represented by Jon D. Hoover of Hoover Law PLLC in Barboursville.

The case has been assigned to Judge Christopher Chiles.
