Sissonville man alleges Kubota tractor malfunctioned while in use, caused him to strike block wall

CHARLESTON – A Sissonville man is suing a tractor company alleging he was injured when the tractor he was using malfunctioned and caused him to strike a wall.

Randy L. Shamblin filed a complaint in Kanawha Circuit Court against Kubota Tractor Corp., State Equipment Inc. and John Does 1-12 alleging strict liability and negligence.

The suit states that the plaintiff was mowing grass with a Kubota tractor mower on Aug. 28, 2017, when it malfunctioned. He alleges the malfunction would not permit him to put the mower in neutral or stop, and he lost control and crashed into a block wall. He alleges he lost consciousness and was injured as a result.

The plaintiff alleges the Kubota tractor mower was defective and unreasonably dangerous at the time of its manufacture and that State Equipment sold it in the defective condition.

The plaintiff is seeking compensatory damages, interest and court costs. The plaintiff is represented by R. Edison Hill of Hill, Peterson, Carper, Bee & Deitzler PLLC in Charleston.

The case has been assigned to Judge Louis Bloom.
