Tenant files suit against Southmoor Hills Apartments alleging that he was injured due to poorly maintained bridge

CHARLESTON – A Kanawha County man is suing his apartment manager alleging he was injured when a footbridge he was using gave away.

Darron Parks filed a complaint in Kanawha Circuit Court against Southmoor Hills Apartments LP and Southmoor LLC alleging negligence.

The suit states that the plaintiff was a tenant at the defendants' apartment on May 28, 2018, and was walking across a foot bridge that was maintained and operated by the defendants. The plaintiff alleges the bridge was negligently maintained and was in a poorly lit area. The plaintiff alleges the bridge gave out, causing him to fall and injure his knee.

The plaintiff also alleges he found bedbugs in his apartment in August 2018 and the defendants unsuccessfully treated the apartment three times.

The plaintiff alleges the defendants breached their duty to provide a safe and habitable premises.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Scott H. Kaminsky of Kaminsky Law PLLC in Charleston.

The case has been assigned to Judge Tera Salango.
