CHARLESTON – A St. Mary's Correctional Center inmate has filed suit against the facility's health care provider and a nurse over allegations he is being denied treatment for his hepatitis C.
According to filing in federal court, Michael Insco filed a civil action against Wexford Health Sources Inc., Pam Moore and John/Jane Doe alleging violation of the U.S. Constitution and intentional/reckless infliction of emotional distress.
"As an entity providing medical services at various West Virginia Correctional facilities, Wexford Health Sources Inc., through its employees, have been deliberately indifferent to the serious medical conditions of Mr. Insco by repeatedly refusing to provide treatment for plaintiff's hepatitis C," the suit states. "These defendants failed to take reasonable and available measures to protect Mr. Insco by acting in a deliberately indifferent manner to the known serious health risks associated with the failure to receive appropriate and available treatment."
According to the suit, Moore continues to deny or recognize Insco's condition and requests for treatment despite his complaints of liver pain.
"Defendant's conduct is malicious and shows no regard for human life," the complaint states.
Insco seeks relief for physical and mental pain and suffering, humiliation, embarrassment and degradation. The plaintiff is represented by Paul Stroebel of Stroebel & Johnson PLLC in Charleston.
