CHARLESTON – A former West Virginia Division of Corrections inmate claims he was "manhandled," placed in a choke hold and forced to urinate on himself because of the conduct of correctional officers.
In his suit filed in the Kanawha Circuit Court, Julian Green alleges the infliction of emotional stress, excessive force/cruel and unusual punishment, and deliberate indifference by the defendants correctional officers Briner, Cpl. Cook and Sgt. McKean, PSIMED Corrections LLC and mental health director Erin Smith.
The suit states Green was formerly incarcerated at Northern Correctional Center and on a date not listed in the suit, was being escorted by correctional officers after he requested mental health treatment. He alleges Cook knocked him to the ground because he wasn't moving fast enough. The plaintiff alleges when he was finally in the medical area, he was manhandled and Briner put him in a choke hold.
The plaintiff alleges he was forced to urinate on himself later because he was in handcuffs and his requests to use the restroom were refused. He alleges the defendants' conduct violated West Virginia Department of Corrections policy to protect inmates from harm.
The plaintiff seeks damages for physical injury, medical expenses, emotional and mental distress as well as punitive damages, pre- and post-judgment interest and litigation costs.
