Kroger faces negligence suit from estate of man who was hit by cart at Huntington store

HUNTINGTON — Kroger and one of its store managers are facing a negligence lawsuit from the estate of a Prichard man who was injured after an employee hit him with a cart while he was shopping at a store in Huntington. 

According to the filing in Cabell Circuit Court, plaintiff Teresa Wilson, as executrix of the estate of James M. Hardwick, filed a negligence suit against the defendants Kroger Limited Partnership I and Saul Adkins. 

The suit states Hardwick was injured on Sept. 19, 2017, while shopping at the Kroger store at 19 West Seventh Ave., Huntington when he was hit by a cart operated by a Kroger employee.

"Defendants Kroger Limited Partnership I and Saul N. Adkins, as manager, were responsible for the actions of its employees, especially when the employees are moving equipment and transporting grocery products which could present a hazard and/or cause injuries to the public...," the suit states. 

The plaintiff seeks compensation, pre- and post-judgment interest and litigation costs. The plaintiff is represented by Kenneth Hicks of Kenneth P. Hicks LC in Huntington. 

The case has been assigned to Circuit Judge Paul T. Farrell.
