WHEELING – An Ohio man who worked at Silgan Plastics' Ohio County facility from 1998 to 2019 alleges that the company did not pay him for time worked beyond his regular shifts and lunch breaks.
According to the filing in Ohio Circuit Court, James Rader Jr. individually and on behalf of all others similarly situated, filed a suit against the defendant Silgan Plastics Corp. citing the West Virginia Wage Payment and Collection Act.
The suit states that the defendant required the plaintiff and class members to work 15 minutes over their regular shifts and did not pay them for this time.
"The defendant did not pay the plaintiff and class members for all their time worked, specifically for the 15 minutes worked over their regular shifts or their lunch breaks," the suit states.
The plaintiff seeks damages allowable under the Wage Payment Collection Act including unpaid wages, benefits, liquidated damages and litigation costs.
The plaintiff is represented by Frank Duff and Sandra Law of Schrader Companion Duff & Law, PLLC in Wheeling.
The case has been assigned to Circuit Judge Michael J. Olejasz.
