Owner of West Charleston building claims Verizon left materials on rooftop it leased for communications facility

CHARLESTON – The owner of a building in West Charleston claims Verizon Wireless leased the building's rooftop to operate a radio communications facility and after cancelling its lease, left heavy metal materials on the roof of the building.

Reed on Couch LLC filed a complaint in Kanawha Circuit Court against Cellco Partnership, doing business as Verizon Wireless, alleging breach of contract. 

The suit states the plaintiff's predecessor in interest and Verizon entered into a lease agreement on April 24, 2008, and in November of 2010, Verizon canceled the lease at the end of the term. Per the agreement, Verizon was to remove all of its equipment within 60 days after the contract's termination, according to the suit. Reed on Couch alleges Verizon only cleared out its communications equipment and left other materials on the rooftop, which is hindering Reed from making needed repairs to its building. 

Reed seeks monetary relief of more than $74,999, trial by jury and other just relief. Reed is represented by Anthony Majestro of Powell & Majestro Law Firm PLLC in Charleston.
