Patron sues Davis' Place after slipping on liquid

HUNTINGTON – A bar and grill in Huntington is facing a lawsuit filed by a customer who slipped on liquid on the floor and suffered injuries. 

James Byrd filed a complaint in Cabell Circuit Court against Giffords Inc., doing business as Davis' Place, alleging negligence. 

Byrd alleges he was at Davis' Place on Dec. 28, 2018, when he slipped on a clear, liquid substance and sustained injuries that rendered him "sick, sore, lame and otherwise disabled." Byrd claims in his suit that Davis' Place took no measures to warn customers about the dangerous and hazardous conditions and that they "should have known about" and taken "reasonable care."

Byrd seeks monetary relief, a trial by jury and all other just relief.  He is represented by Jason Leasure and Matthew Oliver of The Vital & Vital Law Firm LC in Huntington. 

The case has been assigned to Circuit Judge Paul T. Farrell.
