CHARLESTON – A Kanawha County man is suing Ford Motor Co. alleging that his F-150 Raptor pickup did not conform to manufacturer warranties for the vehicle.
John Elmore filed a complaint in Kanawha Circuit Court against Ford Motor Co. alleging violation of the Lemon Law and Magnuson-Moss Warranty Act, breach of express warranties and breach of implied warranty of merchantability, breach of duty of good faith, unfair and deceptive acts or practices and common law fraud.
Elmore purchased his Ford truck on March 29, 2018, which came with a manufacturers' express warranty and warranty that covered repairs and replacements due to factory defects, according to the suit. Elmore alleges he discovered nonconformities with his new vehicle that were not corrected despite three attempts by a dealer at repairs.
The plaintiff alleges he notified the defendant of the truck's alleged defective conditions and Ford failed and refused to provide a replacement vehicle.
Elmore seeks a cancellation of the sales contract, a trial by jury, interest and all other just relief. He is represented by Charles Love IV of The Love Law Firm PLLC in Charleston.
The case has been assigned to Circuit Judge Joanna Tabit.
