CHARLESTON – General Motors is facing a lawsuit by a West Virginia man who claims the automaker has failed to honor its warranty for his Chevy Corvette that has been in and out of authorized dealers for repairs for more than 30 days.
Martin Gargano filed a complaint in Kanawha Circuit Court against General Motors LLC alleging violation of Lemon Law and Magnuson-Moss Warranty Act, breach of express warranties, breach of implied warranty of merchantability, breach of implied warranty of fitness, breach of duty of good faith, unfair and deceptive acts or practices and common law fraud and misrepresentation.
Gargano purchased a 2017 Chevy Corvette from Moses C&O Chevrolet in St. Albans on Sept. 22, 2018, according to the suit. He alleges shortly after purchase, he experienced nonconformities with the vehicle that impaired its use, value and/or safety and took it to a dealer for repair.
He alleges General Motors will not abide by the vehicles' manufacturers' express warranty and warranty that covers repairs or replacements due to defects in factory materials or workmanship.
Gargano seeks to cancel the contract, a trial by jury, interest and all other just relief. He is represented by Charles Love IV of The Love Law Firm PLLC in Charleston.
The case has been assigned to Circuit Judge Charles King.
