West Virginia Insurance Commissioner alleges A+ Repairs failed to maintain workers' comp insurance

CHARLESTON – A business is facing a lawsuit by the state's insurance commissioner alleging it failed to maintain workers' compensation insurance coverage for its employees per state law requirements.  

The state of West Virginia, ex rel West Virginia Offices of the Insurance Commissioner, filed a complaint in the Kanawha Circuit Court against Timothy Cox, doing business as A+ Repairs, alleging violation of West Virginia law. 

The plaintiff alleges Cox has failed to obtain and/or maintain workers' compensation insurance or "has defaulted in payments, thus voiding its coverage" mandated by West Virginia law, the suit states. 

The plaintiff seeks to enjoin Cox from doing business in the state until his fines and penalties have been paid and valid workers' compensation coverage is obtained for his employees. The plaintiff is represented by Travis Ellison III of The West Virginia Insurance Commissioner Office's Legal Service Division in Charleston.
