Woman who slipped, fell at Charleston Taco Bell claims restaurant's negligence

CHARLESTON – A Hewett woman who slipped and fell on a liquid spill at a Charleston Taco Bell is claiming the fast food restaurant's negligence. 

Gayle Dingess filed a complaint in Kanawha Circuit Court against Taco Bell of America LLC alleging negligence. 

Dingess was at a MacCorkle Avenue Taco Bell in Charleston on Oct. 5, 2017, when she slipped on a clear liquid while making her way to the drink counter, according to her complaint. She alleges that after her fall, an employee at the Taco Bell was instructed "to mop up the liquid." 

She alleges the restaurant was negligent for allowing the liquid to accumulate. 

Dingess seeks damages, a trial by jury, interest and all other relief deemed just and proper by the court. She is represented by Robert Kuenzel of Kuenzel Law PLLC in Chapmanville.

The case has been assigned to Circuit Judge Tod Kaufman.
