Lowe's customer files suit after slipping on Wounded Warriors parking space

BECKLEY – Lowe's is facing a negligence claim by a man who fell and slipped on a painted Wounded Warriors parking spot sign at its Beckley location.

Troy Osborne Sr. filed a complaint in Raleigh Circuit Court against Lowe's Home Centers alleging negligence. 

According to his complaint, Osborne was in the parking lot of the Lowe's in Beckley on Sept. 1, 2017, when he parked his vehicle next to an area that had been painted as a designated Wounded Warriors spot. The plaintiff alleges the painted surface was wet due to a recent rain, which caused him to slip and fall and sustain injuries to his head, shoulder, knee and wrist.

Osborne seeks compensatory damages, a trial by jury, interest and all other relief available under applicable law. He is represented by Kurt Entsminger and Phillip Estep of the Entsminger Law Group PLLC in Charleston. 

The case has been assigned to Circuit Judge Robert A. Burnside Jr.
