Wyoming County couple alleges Nissan, dealership won't honor warranty on defective truck

PINEVILLE – A Wyoming County couple who purchased a new Nissan truck from a Beckley dealership alleges the truck has a defect and that the seller and manufacturer failed to honor its warranty.

Timmy Mitchell and Elizabeth Mitchell filed a complaint in Wyoming Circuit Court against Nissan of North America Inc. and Lewis One Plaza Center Corp. alleging violation of West Virginia law. 

The Mitchells allege they purchased a new 2017 Nissan Truck Rogue for $28,779 from Lewis Center Corp. in February of 2018. The vehicle came with a five-year, 60,000-mile warranty and the Mitchells alleged after a series of repairs for the defect of loss of engine power and other issues, the defendants failed to honor the warranty. 

The Mitchells seek monetary relief of no less than $36,557.73, a trial by jury and all other relief under applicable statutes. They are represented by David Thompson of The Thompson Law Office in Pineville.
