Raleigh General Hospital doctors face suit by woman who alleges she lost kidney due to injury during spinal fusion

BECKLEY – A Pool woman has filed a suit against two physicians at Raleigh General Hospital after suffering a ureteral injury during a spinal fusion procedure that allegedly went undiagnosed and resulted in the loss of her kidney. 

Mary Bennett filed a complaint in Raleigh Circuit Court against Dr. Rajesh Patel and Dr. Brian Whyte alleging negligence. 

The suit states Bennett underwent an anterior spinal fusion on Aug. 29, 2017, that was performed by the defendants at Raleigh General Hospital. Bennett alleges she suffered a ureteral injury that went unrecognized and undiagnosed by the defendants, which led to permanent injuries and kidney loss. 

Bennett seeks damages, a trial by jury, interest and all other appropriate relief. She is represented by Ben Salango and Kristina Salango of Preston & Salango PLLC in Charleston. 

The case has been assigned to Circuit Judge H.L. Kirkpatrick III.
