Man injured in Route 60 accident sues Wholesale Tire over its driver's alleged negligence

HUNTINGTON – Wholesale Tire is facing a suit filed by a Huntington man who was injured in a Route 60 vehicle accident allegedly caused by one of the company's drivers. 

Burley Maynard filed a complaint in Cabell Circuit Court against Gary Lee Davis and Wholesale Tire Inc. alleging negligence. 

The suit states Maynard was traveling on Route 60 at Fudge's Creek Road in Ona on Oct. 5, 2017, when a Wholesale Tire Ford cargo van driven by Davis crashed into Maynard's Chrysler 200 sedan. Maynard alleges he suffered injuries to his head, neck, back, limbs and the aggravation of a previous existing defect.

Maynard is in a dispute with State Farm Mutual Automobile Insurance Co. over the amount and coverage of the accident claim, according to the complaint. 

Maynard seeks a trial by jury and all other relief the court deems appropriate. He is represented by R. Matthew Vital of Vital & Vital LC in Huntington. 

The case has been assigned to Circuit Judge Gregory L. Howard Jr.
