Couple alleges Burger King was negligent in allowing wet floor that caused slip

PRINCETON – A Marshall County couple is suing Burger King after the wife allegedly slipped and injured herself while walking into the Moundsville restaurant. 

Shirley Dulaney and Timothy Dulaney filed a complaint in Marshall Circuit Court against Carrols LLC alleging negligence. 

Shirley Dulaney alleges she was at the defendant's Burger King in Moundsville on Oct. 5, 2017, when she slipped "on her first step inside the doorway," fell and hit the ground. Dulaney alleges her fall was due to a wet floor at the Burger King and claims her injuries are the result of the restaurant's negligence in allowing the unsafe condition to exist. 

The plaintiffs seek an amount to compensate them for damages, interest and all other just relief. They are represented by Eric Gordon of Berry, Kessler, Crutchfield, Taylor and Gordon in Moundsville. 

The case has been assigned to Circuit Judge David Hummel.
