Former Triple T Timbering truck driver claims he was fired for reporting safety concerns with truck

KINGWOOD – A former truck driver for Triple T Timbering claims he was fired in retaliation for reporting safety concerns with his assigned truck.  

Michael Deberry filed a complaint in Preston Circuit Court against Triple T Timbering LLC and Greg Thomas alleging violation of West Virginia law.

Deberry began working for Triple T as a truck driver on Feb. 12, 2018. He alleges in his complaint that beginning on April 12, 2018, he informed Triple T owner Thomas on several occasions about safety concerns with his assigned truck, including mechanical failures and catching on fire. He claims Thomas failed to fix the issues and directed him to continue to drive the truck, so he advised the defendants he would have to report it to the Department of Transportation and the Occupational Safety and Health Administration.

On July 22, Deberry claims he was then fired immediately in retaliation for reporting safety concerns.

Deberry seeks damages, a trial by jury, interest and all other just relief. He is represented by Erika Klie Kolenich of The Klie Law Offices PLLC in Buckhannon. 

The case has been assigned to Circuit Judge Steven L. Shaffer.
