CSX faces suit by former conductor alleging exposure to asbestos caused his lung cancer

MOUNDSVILLE – A former railroad conductor and brakeman is suing CSX claiming his exposure to asbestos and other harmful fumes caused his lung cancer. 

Billy Vaughn filed a complaint in Marshall Circuit Court against CSX Transportation Inc., individually and as successor-in-interest to The Chessie System Inc.; The Baltimore & Ohio Railroad and The Chesapeake & Ohio Railway citing the Federal Employers' Liability Act and the Locomotive Boiler Inspection Act.

According to his complaint, Vaughn worked as a brakeman and conductor throughout West Virginia for the defendants and was diagnosed with lung cancer in August 2019. He alleges his cancer is a result of his exposure to asbestos, diesel exhaust, sand, silica, coal dust and other "harmful dust and fumes" and that the defendants failed to minimize or eliminate his exposure. 

Vaughn seeks judgment in his favor, trial by jury and all other just relief. He is represented by Leslie James of The Hartley Law Group PLLC in Wheeling. 

The case has been assigned to Circuit Judge Jeffrey Cramer.
