CHARLESTON — An RN is suing the West Virginia Department of Health and Services claiming they gave a false background report that caused her to lose a job offer.
April Cowan filed a complaint in Kanawha Circuit Court against the West Virginia Department of Health and Human Resources alleging tortuous interference.
Cowan has been registered with the state as an RN since 2005. She alleges that in June of 2019, she applied for and was offered a job at Highland Hospital but that her job offer was rescinded due to a background check the West Virginia Department of Health and Human Resources had communicated to the hospital. Cowan claims the Department falsely reported that she was the subject of a substantiated claim of maltreatment.
Cowan seeks to have the West Virginia Department of Health and Human Services correct her report, monetary and all other appropriate relief. She is represented by Walt Auvil, Kurt Auvil and Anthony Brunicardi of The Employment Law Center in Parkersburg.
