Couple sues Hyundai, auto dealership claiming their new Santa Fe suffers from engine power loss

PRINCETON — A couple is suing Hyundai and a West Virginia auto dealership claiming their new Santa Fe continues to stall out despite numerous repair attempts. 

Karen Moulder and Terry Moulder filed a complaint in Mercer Circuit Court against Hyundai Motor America Inc., and Bilco Inc., doing business as Pantili Hyundai. They allege violation of the Magnuson-Moss Warranty Act and other claims. 

The Moulders purchased a new 2017 Hyundai Santa Fe from Pantili Hyundai in Princeton on Oct. 22, 2017. They allege that two days after the vehicle received a software update at the Pantili dealership on Feb. 23, 2019, the car lost power while they were driving on the interstate. The Moulders claim that despite many repair attempts over the next several months by Pantili, the car continued to have loss of engine power. 

The Moulders seek monetary and all other proper relief. They are represented by Jed Nolan of Nolan Consumer Law PLLC in Athens. 

This case has been assigned to Circuit Judge Derek Swope.
