Woman sues landlord alleging hole in sidewalk caused her fall, injuries

CHARLESTON — A woman is suing her landlord claiming she fell and suffered injuries when her foot got caught in a hole on the sidewalk at the home she was renting.

Dannita Jolly filed a complaint in Kanawha Circuit Court against James Shaw, individually and Real Estate Central LLC alleging negligence. 

Jolly alleges in her complaint that her foot became stuck in a hole in the sidewalk on April 2, 2018, at the home in Dunbar which she and her husband rented from Real Estate Central. She claims she was thrown backwards, causing her to hit the ground and hurt her her head, shoulder and back. Jolly also claims Real Estate Central's maintenance person became aware of the hole in the sidewalk while installing her husband's wheelchair ramp but did not repair the issue until after her fall. 

This case has been assigned to Circuit Judge Joanna Tabit. Kanawha Circuit Court case number 20-C-190
