Accountant blamed for couple, business being audited by IRS

WINFIELD – A Raleigh County couple and a Putnam County business say an accountant wrongly filed federal taxes that forced them to pay back taxes, penalties and interest.

Jamison and Jennifer Humphrey and MCP Enterprises LLP filed a complaint against Greenleaf and Associates Consulting Inc. and Michael Greenleaf.

According to the complaint, the plaintiffs hired Greenleaf, who lives in Scott Depot, and his company, which is based in Nitro, to perform accounting and other services. That included preparing various tax documents for the year 2013.

The Internal Revenue Service audited the plaintiffs’ tax returns for 2013 and found them to be incorrect, resulting in hem owing substantial back taxes as well as penalties and interest.

“The defendants refused to correct the errors made by them resulting in the back taxes owed and penalties and interests,” the complaint states. The plaintiffs say they had to acquire the services of Advantage Accounting to reconstruct the books, Rufus Miller & Associates to prepare amended tax forms and Fredeking & Fredeking Law Offices to file a petition in the federal court contesting the back taxes, penalties and interest. That resulted in those being waived by an order in 2019.

But, the plaintiffs said they still incurred substantial attorney fees and costs as well as substantial loss of time, aggravation, annoyance and inconvenience. They have requested other documents from the defendants, but they say the defendants have failed to produce and provide them.

The plaintiffs seek joint and several compensatory damages, punitive damages, interest, court costs, attorney fees and other relief.

The plaintiffs are represented by Paul E. Biser of Fredeking & Fredeking in Huntington. The case has been assigned to Circuit Judge Joseph Reeder.
