Another woman says Beckley's Planet Fitness videotaped her in tanning beds

BECKLEY – A woman has filed a lawsuit claiming an employee of the Beckley location of Planet Fitness was criminally videotaping patrons using tanning beds.

Sandra Crowe filed her complaint in Raleigh Circuit Court against United PF LOM LLC, doing business as Planet Fitness United, and Pla-Fit Franchise LLC.

According to the complaint, Crowe was a member of Planet Fitness in June 2019 when she learned an employee was videotaping patrons using tanning beds and viewing them.

She says she didn’t consent to the surreptitious behavior by the employee(s), and she says she cancelled her membership in writing as required. But she says that request was denied and continues to be charged her membership fee. She says the illegal videotaping and viewing of patrons in the tanning bed area voided the membership agreement.

She says the defendants have breached the contract and now are attempting to collect a debt she doesn’t owe, which is a violation of the West Virginia Consumer Credit and Protection Act.

She seeks joint and several compensatory and statutory damages.

Crowe is being represented by Greg Hewitt and Anthony Salvatore of Hewitt & Salvatore in Fayetteville. Last year, Hewitt and Salvatore filed a similar potential class-action complaint on behalf of a woman and others similarly situated. It is scheduled for trial later this year. Both cases been assigned to Circuit Judge H.L. Kirkpatrick.
