Woman blames Amazon for injuries from wall charger; Amazon says it didn't manufacture product

PINEVILLE – A Wyoming County woman blames Amazon for injuries she sustained because of a defective wall charger.

According to her complaint filed in Wyoming Circuit Court against Amazon.com LLC, Kasey West purchased a wall charger in 2018. She says the charger was defective and “violently shorted producing flame, light and heat.”

In its answer, Amazon says isn’t responsible for the plaintiff’s injuries. It also says it did not design, manufacture or ship the product. It also says the product was misused and altered from its original form. It seeks to have the case dismissed.

“The plaintiff’s injuries were caused by an intervening act from a person or party over whom defendant did not control,” the answer states. “Plaintiff, as of the date of filing this answer, has failed to produce any facts sufficient to identify the manufacturer, make or model of the subject product, or any details about how or when the product was purchased from defendant.”

West says the short caused her to suffer burns, pain and suffering, injury, medical costs and inconvenience. She seeks compensatory and special damages as well as pre- and post-judgment interest.

She is being represented by Pineville attorney Timothy P. Lupardus. Amazon is represented by Brian A. Cafritz and Matthew L. Liller of Kalbaugh Pfund & Messersmith P.C. in Richmond, Virginia. The case has been assigned to Circuit Judge Warren McGraw.
