Couple says CAMC failed to prevent patient falls

CHARLESTON — A woman and her husband allege Charleston Area Medical Center was negligent when it failed to implement fall measures for patients.

Kimberly Blizzard was a patient at CAMC on three separate occasions between November 19, 2018, and Jan. 20, 2019, according to a complaint filed in Kanawha Circuit Court. She and Michael Blizzard claim that during her admissions, the hospital failed to provide any sort of preventative measures to keep her from falling.

After a severe fall, the Blizzards allege that Kimberly Blizzard suffered a subarachnoid hemorrhage and a right frontal contusion that decreased her mobility and caused her to require rehabilitation treatment, according to the suit.

The Blizzards claim CAMC failed to take preventative measures so that Kimberly Blizzard wouldn't fall and, because of that, it breached its duty of care.

CAMC's negligence caused Kimberly Blizzard's fall, which also resulted in aggravation of existing diseases, among other problems, including incurring medical expenses, according to the suit.

The Blizzards are seeking compensatory and punitive damages. They are represented by Jeff D. Stewart, Andrew L. Paternostro and S. Andrew Stonestreet of Stewart Bell PLLC in Charleston

The case is assigned to Circuit Judge Joanna Tabit.
