Woman files suit after tripping, injuring herself at Raleigh County cemetery

SUMMERSVILLE – A Raleigh County woman says she ended up paying more than her respects following a trip to a Beckley cemetery … to the tune of more than $50,000 in medical bills.

Pamela Garretson of Beaver filed her complaint in Raleigh Circuit Court against Sunset Memorial Park Company.

According to her complaint, Garretson was visiting the cemetery May 11, 2018, when she says she fell because of a hidden defect in a step. She sustained an injury to her left ankle and leg as well as bruises to other parts of her body. She went to Med Express for X-rays and ended up being under the care of an orthopedic surgeon.

She says a subsequent fall in her yard was caused by weakness in her injured left ankle. She sustained additional injuries requiring medical care.

Garretson says she has sustained permanent injuries, medical expenses and other economic damages. She says she also has suffered pain and suffering, annoyance and inconvenience, humiliation and loss of enjoyment of life.

She seeks compensatory damages in an amount not less than $50,000 to compensate her for her economic and non-economic losses. She also seeks pre- and post-judgment interest, attorney fees, court costs and other relief.

Garretson is being represented by Beckley attorney Michael E. Froble. The case has been assigned to Circuit Judge Robert Burnside.
