Woman sues after tripping on storm grate in Wendy's parking lot

WHEELING – An Ohio woman is suing a Wheeling location of Wendy’s after she tripped and fell over a storm grate in the restaurant parking lot.

Sara Voyles of Cambridge filed her complaint against Primary AIM LLC and HEJ Capital LTD/Wendy’s in Ohio Circuit Court. The defendants operate the Wendy’s at Crossing Mall.

According to her complaint, Voyles was a guest at the restaurant Sept. 11, 2018, when she tripped and fell over a “dangerous, defective and unsafe” storm grate that wasn’t level in the parking lot. Voyles said she twisted her left ankle.

She says the defendants failed to adequately inspect, maintain and repair the premises as well as failed to warn patrons of the danger and provide a safe business premises.

Voyles says she sustained injuries to her bones, tissues, ligaments and tendons in her left ankle. She seeks compensatory damages for medical bills, pain, suffering, emotional distress and inconvenience.

She is being represented by attorney Thomas D. Hall of Pittsburgh. The case has been assigned to Circuit Judge Ronald E. Wilson.
