Mingo Co. residents say airbags didn't deploy in their Chevrolet Cruz

WILLIAMSON – Three Mingo County residents have sued General Motors, saying they were injured in a vehicle accident because the air bags did not deploy.

Mark Hurley, Shayla Cox and Amanda Cox filed their lawsuit against GM in Mingo Circuit Court.

According to the complaint, the plaintiffs were properly restrained in the 2014 Chevrolet Cruz on Nov. 30, 2018, when they sustained injuries in a single-car accident. They say they were injured because the air bags in the car did not deploy properly.

They accuse GM of failure to warn, negligent design, breach of express and implied warranties as well as negligence.

The plaintiffs seek compensatory damages, court costs, attorney fees, pre- and post-judgment interest and other relief.

They are being represented by Greg Smith of the Law Office of Greg K. Smith in Williamson. The case has been assigned to Circuit Judge Miki Thompson.
