WHEELING – A woman has sued Sheetz after she says she was attacked by a fellow customer during a visit to a Wheeling location of the convenience store.
Katrina Smith and her daughter Kathrina “Katy” Smith filed the suit against Stacey Davis and Sheetz Number 362.
According to the complaint, Katrina Smith says she was a customer at the National Road location March 18, 2018, when Davis grabbed her by the hair, spun her around, threw her to the ground and began hitting her. Smith says her minor daughter Katy witnessed the attack and then was forcibly thrown into a candy display by Davis. The daughter also was injured.
The plaintiffs accuse Davis of battery, negligence and negligent infliction of emotional distress on both of them. They also accuse Sheetz of negligence by allowing them to be battered and attacked by Davis, saying Sheetz took no action to remove Davis “despite the pleas and screams of both plaintiffs.”
Katrina Smith says both she and her daughter sustained injuries to their head, neck, back, shoulders, extremities, body chemistry, psyche, muscles, tissues, fascia and other body parts as well as other internal and external injuries. She says they also have suffered great pain of body and mind, medical expenses, diminution in ability and capacity to care for themselves and enjoy a normal life as well as future loss of earning capacity.
They seek compensatory damages, pre- and post-judgment interest, court costs and other relief.
They are being represented by Ronald W. Zavolta and Paul J. Ratcliffe of Zavolta Law Office in Wheeling. The case has been assigned to Circuit Judge Michael J. Olejacz.
