WHEELING – A Pittsburgh couple blames Wheeling Island Gaming after the woman injured herself on a casino sidewalk.

Julia and Timothy Baker filed a complaint against Wheeling Island Gaming Inc., doing business as Wheeling Island Hotel, Casino & Racetrack, in Ohio Circuit Court.

According to the complaint, Julia Baker was visiting the casino July 31, 2018, when she fell on the sidewalk. She says the sidewalk was uneven and hazardous, and she says she sustained severe and disabling injuries.

The plaintiffs say Wheeling Island Gaming failed to conduct a reasonable inspection of the premises, failed to maintain its premises, failed to main the sidewalk, failed to correct dangerous and/or hazardous conditions on the premises and failed to warn the plaintiff and other guests of dangerous conditions.

Julia Baker says she was forced to seek medical treatment, incur medical expenses, has incurred pain and suffering, mental anguish, aggravation, inconvenience, loss of enjoyment of life, loss of ability to function, lost wages and past and future medical and other expenses.

Timothy Baker says he has suffered a loss of consortium.

They seek compensatory damage, pre- and post-judgment interest, court costs and other relief.

They are being represented by M. Eric Frankovitch of Frankovitch Anetakis Colantonio & Simon.
