Man blames 7-Eleven after he steps on mop and injures himself at Weirton store

NEW CUMBERLAND – A Weirton man says he was injured when he stepped on a mop in an aisle at 7-Eleven.

Jason McNicholas filed his complaint in Hancock Circuit Court against Umstott Inc. doing business as 7-Eleven Store 36165 in Weirton.

According to the complaint, McNicholas went to the store July 1, 2018, to buy snacks.

“The plaintiff came around the corner and stepped on a mop that was laying on the floor in one of the aisles, causing the plaintiff to fall and injure himself,” the complaint states.

He says 7-Eleven was negligent in failing to provide a safe environment, in causing a dangerous and unsafe condition, in failing to warn plaintiff and others of the dangerous condition and in failing to care for the safety of the plaintiff.

McNicholas says he endured great pain, suffering, inconvenience, embarrassment, mental anguish and emotional and psychological trauma. He said he has had to spend large sums of money for medical treatment and care, hospitalization, medical supplies, rehabilitation and therapeutic treatment, medicines and other services. He also says his general health, strength and vitality have been impaired and that he has been unable to enjoy various pleasures of life he previously could enjoy.

He seeks compensatory and punitive damages, pre- and post-judgment interest, court costs, attorney fees and other relief.

McNicholas is being represented by Dean G. Makricostas of Dittmar, Taylor & Makricostas in Weirton. The case has been assigned to Circuit Judge Jason Cuomo.
