Barbour County couple says Chevrolet Silverado they purchased new is a lemon

PHILIPPI – A Belington couple says the Chevrolet Silverado they purchased is a lemon.

James and Katrina R. Davis filed their complaint against General Motors in Barbour Circuit Court.

According to the complaint, the couple purchased the 2019 Silverado on July 23, 2019, from Mark Porter Chevrolet in Pomeroy, Ohio, for $62,800. Shortly after purchase, the couple says they began having repeated problems with the vehicle. There were at least six repair attempts through July 2020. They say they have been without the use and benefit of their vehicle for more than 30 days because of the defects.

The Davis' accuse GM of breach of express warranty, breach of implied warranty, breach of the West Virginia New Motor Vehicle Warranty Act and breach of the Magnuson-Moss Warranty Act. Because of the issues with the truck, they also say they are entitled to revoke their acceptance of the vehicle and to have all money refunded to them based on the Uniform Commercial Code.

They seek the revocation and refund as well as damages for the cost of repairs, loss of use, annoyance, inconvenience, attorney fees, pre- and post-judgement interest and other relief.

The plaintiffs are being represented by John N. Ellem of Ellem Law Office PLLC in Parkersburg.
