LITTLER MENDELSON PC: COVID-19 Labor & Employment Litigation Tracker

Littler Mendelson P.C. issued the following announcement on Sept. 4.

Since March 12, there have been 638 lawsuits (including 72 class actions) filed against employers due to alleged labor and employment violations related to the coronavirus. The filings have increased rapidly over the past several months:

9 complaints from March 12 – 31;

52 complaints in April;

93 complaints in May;

135 complaints in June;

160 complaints in July;

174 complaints in August; and

15 complaints as of September 3.

California is leading the way with 115 cases filed, with Florida (70), New Jersey (70), and New York (53) following closely behind. The most common complaints have focused on retaliation (282), wrongful termination (199), workplace safety (149), leaves of absence (144), and discrimination (107). The healthcare industry has been hardest hit by COVID-19 employment litigation with 159 alleged violations.
