Man blames former employer after falling more than six feet onto concrete pad

WINFIELD – A Mason County man blames his former employer for injuries he suffered on the job.

Anthony Blessing filed his complaint against Aracoma Ready Mix Inc. doing business as Cardinal Concrete Co. in Putnam Circuit Court.

According to the complaint, Blessing was working for the defendant on May 30, 2019, as a truck driver. He says he was injured when he was asked to start a loader. He says that was outside of his job description and training.

Blessing says he fell more than six feet from the platform of the loader onto a concrete pad. He says he sustained injuries that included a cervical injury, head injury with concussion, separated shoulder and fractures to his clavicle and shoulder.

He says the defendant exposed him to unsafe working conditions. As a result, he said he has suffered the injuries, required surgery, rehabilitation and other medical attention, endured pain and suffering, lost wages, a diminished earning capacity, loss of enjoyment of life and other damages.

He seeks compensatory damages, punitive damages, pre- and post-judgment interest, court costs, attorney fees and other relief.

In its answer, Aracoma Ready Mix denies any wrongful action on its part and seeks to have the case dismissed.

Blessing is being represented by Scott Kaminski of Kaminski Law in Charleston. The defendant is being represented Nathaniel Kuratomi and Dakota Warner of Jenkins Fenstermaker in Huntington.
