CLARKSBURG – A Taylor County man says he was injured by a trailer hitch while shopping at Walmart.
Harley Green filed his complaint in federal court against Wal-Mart Stores East Inc.
According to the complaint, Green was shopping at the Grafton Walmart on April 1, 2019, when he lifted a box containing a Curt Class 3 Multi-Fit Trailer Hitch #13900 from the shelf. When he lifted it, the hitch ripped through the packaging and fell, injuring his foot and knocking him down and causing him to strike his head on the floor. He says he sustained other injuries as well.
Green blames Walmart and its employees for negligently maintaining the department, shelves and packaging for items.
He seeks compensatory damages for pain and suffering, emotional distress, inconvenience, loss of capacity to enjoy life, medical expenses, life care expenses and other damages. He also seeks pre- and post-judgment interest and other relief.
In its answer to the complaint, Walmart denies the claims and seeks to have the case dismissed.
