South Carolina man says spoiler issue has rendered $89,000 BMW worthless

CHARLESTON – A South Carolina man says a BMW he purchased in West Virginia is a lemon.

Matthew Corbit of Fort Mill, S.C., filed his complaint in Kanawha Circuit Court against BMW of North America Inc.

According to the complaint, Corbit purchased a new BMW X3 on May 1, 2020 for almost $95,000 from Moses Auto Group in St. Albans. The purchase included an express four-year/50,000-mile warranty.

After purchase, Corbit says he experienced issues with the vehicle including the spoiler and related paint defects. Because of ineffective repair attempts by BMW, Corbit says the car’s value is impaired and it’s unable to be used for its intended purposes. He deems the car worthless to him.

Corbit says BMW has violated the West Virginia New Motor Vehicle Warranties Law as well as the Moss-Magnuson Warranty Act.

He seeks to have the contract for the vehicle canceled by rejection, rescission or revocation of acceptance. He also seeks compensatory damages for the money or value lost, including consequential and incidental damages, court costs, attorney fees, pre-judgment interest and other relief.

Corbit is being represented by Chad Doman and Christopher Componovo of Kimmel & Silverman PC in Pittsburgh. The case has been assigned to Circuit Judge Joanna Tabit.
