Pa. woman says she was injured during fall at Mountaineer Casino Racetrack & Resort

NEW CUMBERLAND – A Pennsylvania woman says she was injured because of the negligence of Mountaineer Casino Racetrack & Resort.

Joanne Futato of Aliquippa in Beaver County filed her complaint in Hancock Circuit Court against Mountaineer Park Inc., MTR Gaming Group Inc. and Eldorado Resorts Inc. The trio of businesses together do business as Mountaineer Casino Racetrack & Resort.

According to her complaint, Futato was a guest June 19, 2019, when she slipped and fell while walking through the facility because of hazardous conditions and/or substances. She says the incident caused her to sustain severe and disabling injuries.

Futato says the defendants failed to conduct a reasonable inspection of the premises, failed to maintain the premises, failed to correct the dangerous and/or hazardous conditions and failed to warn the plaintiff and others of dangerous conditions.

She says she had to seek medical treatment, incur medical expenses, pain and suffering, mental anguish, aggravation, inconvenience, loss of enjoyment of life and loss of ability to function. She seeks joint and several damages as well as pre- and post-judgment interests, court costs and other relief.

Futato is being represented by Kevin Pearl of Frankovitch, Anetakis, Simon, DeCapio & Pearl in Weirton. The case has been assigned to Circuit Judge David Sims.
