Former Mylan employee says he was fired because of his age

MORGANTOWN — A former Mylan Pharmaceuticals employee says he was discriminated against when he was fired.

Kenneth K. Zara filed the lawsuit against Mylan Pharmaceuticals, Viatris Inc. and Mike Frisco for discrimination after he was fired on Jan. 22, 2019, according to a Jan. 22 complaint filed in Monongalia Circuit Court.

Zara was employed as the fluid bed coordinator and in 2016, after he turned 60, his supervisor, Byron Stevens, made a comment that Zara wasn't as young as he used to be after he was off work for his degenerative arthritis. Stevens suggested that Zara retire early.

Several weeks later, Stevens made another comment about his age and suggested he either retire or take another position that wasn't as physically demanding, according to the suit.

Zara claims in 2019 he was fired for a purported mistake but, in reality, he was fired because he resisted the pressure to take early retirement.

Zara is seeking compensatory and punitive damages with pre-judgment interest. He is represented by Drew M. Capuder of Capuder Fantasia in Fairmont.
