Woman says cheeseburger from Applebees gave her food poisoning

CHARLESTON – A Charleston woman says an undercooked cheeseburger from Applebee’s led to food poisoning, medical treatment and lost work.

Kharis Hairston filed her complaint last month in Kanawha Circuit Court against Legacy Apple III LLC doing business as Applebee’s Grill and Bar.

According to her complaint, Hairston purchased a cheeseburger meal to go from the Applebee’s at Kanawha Mall in Kanawha City on August 24, 2020.

“After ingesting a significant portion of the meal, she soon discovered that she had consumed undercooked beef,” the complaint states. “Soon thereafter, Ms. Hairston became very ill and suffered extreme symptoms of food poisoning including vomiting, diarrhea and dehydration.”

She sought treatment at MedExpress and later at Charleston Area Medical Center’s Women’s and Children’s Hospital. Because of the foodborne illness, she also missed several days of work.

Hairston blames the defendant’s negligence or reckless actions for her injuries. She seeks compensatory damages as well as attorney fees, court costs and other relief.

She is being represented by Michael M. Cary of Cary Law Office in Charleston. The case has been assigned to Circuit Judge Tod Kaufman.
