CHARLESTON – An elderly Charleston woman says she fractured her leg when she fell because of a hazard outside a Kroger grocery store.
April Perrine filed her complaint February 4 in Kanawha Circuit Court against The Kroger Co. and Kroger Limited Partnership I.
According to her complaint, Perrine was visiting the Kroger at 500 Delaware Avenue in Charleston on December 12, 2020. As she was walking into the store, she says she suddenly fell because of a metal beam protruding from what once was the cart return area beside the store entrance. Perrine says she shattered her femur and was transported to Charleston Area Medical Center’s General Hospital.
Perrine’s attorney said he believes the metal beam still is there.
“I’m glad my client is receiving all of the medical treatment needed for her injuries,” Michael M. Cary of Cary Law Office in Charleston told The West Virginia Record. “I’m praying for a speedy recovery.”
Perrine says she required extensive medical treatment, including surgery. She accuses the defendants of negligence and premises liability.
“Furthermore, the plaintiff did not receive any sort of assistance from the defendant’s employees or supervisor,” the complaint states. “While waiting for the ambulance, witnesses informed an employee who was present at the time of the incident.”
Perrine says the defendants’ negligent conduct caused her to suffer physical injury, pain and suffering, emotional distress, annoyance, inconvenience, aggravation and medical expenses. She seeks compensatory damages as well as attorney fees, court costs and other relief.
